Associate Coverage Counsel
The candidate will serve as an internal resource for the Claims Department in making coverage determinations for workers' compensation and liability claims submitted under policies for which the company is the claims administrator. Provide guidance to claim adjusters, supervisors and managers concerning coverage for claims under policies as well as reviewing coverage position letters prior to issuance. Work with claims and outside coverage counsel to manage coverage litigation. Provide coverage analysis to the Claims Department. Give guidance on additional investigation that may be required to resolve coverage issues. Communicate with underwriting for policy issue clarification. Inform concerning jurisdictional nuances. Review and recommend appropriate revisions to coverage position letters drafted by claims adjusters prior to issuance. Make referrals to and communicate with outside coverage counsel. Review, analyze and provide recommendations to Claims based on outside counsel opinions. Communicate and strategize with Claims concerning settlement of underlying claims for which coverage issues exist. Review and analyze substantive documents/reports drafted by outside coverage counsel – complaints, answers, initial case evaluations, initial discovery disclosures, deposition summaries, pre-trial reports. Ensure timely filing and reporting by outside coverage counsel. Strategize with Claims concerning development/direction of coverage litigation. Should have a JD from an ABA-accredited law school. Must have 3+ years of industry experience with focus on liability insurance coverage.
