EPL & D&O Liability Associate Claim Counsel - Job Summary:
The EPL & D&O Liability Associate Claim Counsel will be responsible for conducting thorough investigations and analyses of claims and claim litigation for the Bond & Specialty Insurance (BSI) team. This role will also provide legal advice to underwriting and non-attorney claim colleagues, as well as participate in strategic initiatives for BSI claims. The ideal candidate will have 1-5 years of relevant legal or claim handling experience, a Bachelor's degree, and a Juris Doctorate degree. Responsibilities:
- Analyze and resolve BSI claims with supervision from claims management, following operational policies.
- Prepare and present reports for management on loss development, financial exposure, reserve adjustments, coverage issues, and claim and recovery strategies.
- Manage outside counsel and actively utilize litigation management plans and budgets.
- Communicate with underwriting on significant claim exposures.
- Attend mediations, settlement conferences, claim conferences, field office visits, trials, and depositions as needed.
- Identify and coordinate recovery opportunities with the Recovery Management Unit and Claim management.
- Refine policy interpretation and coverage analysis skills, including drafting coverage opinions with case law.
- Negotiate settlements and review releases and settlement agreements, including confidentiality and non-disclosure provisions.
- Support underwriting marketing efforts, including client visits and risk mitigation seminars.
- Stay updated on marketplace conditions and draft reference materials to inform underwriting and claim decisions.
- Obtain and maintain required adjusters' licenses.
- Perform other duties as assigned.
Qualifications:
- 1-5 years of relevant legal or claim handling experience.
- Bachelor's degree and Juris Doctorate degree.
- Properly licensed, registered or authorized, and in good standing, to practice law in the jurisdiction in which you will be working.
- Ability to effectively resolve conflicts and make sound decisions.
- Strong communication skills, both verbal and written.
- Time management skills and attention to detail.
- Ability to build and maintain relationships with colleagues, customers, and business partners.
