Job Description:
- Handle all incoming requests for DSS/HRA/DHS agency records, including providing policy statements and legal responses, quashing subpoenas, and responding to Freedom of Information Law (FOIL) requests.
- Responsible for tracking and maintaining files, retrieving records, and determining whether records may be released under applicable laws.
- Provide legal counsel and assistance to agency program areas and departments, researching legal questions and interpreting laws and regulations.
- Draft and review legal documents, prepare legal opinions, and represent the Commissioner in judicial proceedings.
- Conduct legal research and provide guidance to other attorneys and support staff.
Responsibilities:
- Review FOIL requests from outside requestors and determine availability of responsive materials.
- Review requests for records not under the FOIL statute and determine availability and legal adequacy of subpoenas and court orders.
- Provide guidance on release of materials and initiate legal actions if necessary.
- Handle FOIL litigation and motions to quash subpoenas, as well as New York Civil Practice Law and Rule (CPLR) Article 78 proceedings.
- Conduct legal research and prepare memoranda for consideration by agency managers.
- Provide legal counseling and assistance to agency program areas and departments.
- Draft and review legal documents and opinions.
- Represent the Commissioner in judicial proceedings.
- Conduct legal discovery and research complex legal issues.
- Provide guidance and training to other attorneys and support staff.
Minimum Qualifications:
- Admission to the New York State Bar.
- One year of satisfactory United States legal experience subsequent to admission to any state bar, or six months of satisfactory service as an Agency Attorney Interne (30086).
- Must remain a member of the New York State Bar in good standing for the duration of employment.
Preferred Skills:
- Strong oral argument and written advocacy skills.
- Knowledge of employment law.
- Ability to articulate the law and advocate on behalf of the agency.
- Superior legal research, writing ability, and time management discipline.
Salary Range: $89, – $103,
