Job Title: Law Clerk 2025 - 2026

Job Responsibilities:
Law clerks in the **MEMBERS ONLY**SIGN UP NOW***. are entrusted with a variety of essential duties that contribute to the functioning of the court system. Their responsibilities vary depending on the court division they serve.

Supreme Court Law Clerks:
- Work with justices on complex cases involving difficult legal issues.
- Perform legal research and prepare written memoranda on novel issues of law.
- Assist the justices in the preparation of opinions.

Appellate Division Law Clerks:
- Conduct research and analyze legal data.
- Prepare legal memoranda and process emergent motion applications.
- Proofread published opinions and edit the opinions authored by their judge and other judges.
- Handle emergent applications and prepare summer research memos.

Trial Court Law Clerks:
- Gain practical experience by observing judicial proceedings and attending conferences with attorneys and judges.
- Receive training in mediation and mediate small claims cases.
- Summarize information for judges and assist with case management functions.

Tax Court Law Clerks:
- Review and process motions filed with the court.
- Conduct legal research to inform a judge’s options and motions.
- Draft case management orders and other legal documents.
- Assist with or act as a moderator for remote proceedings.

Assignment Judge Law Clerks:
- Conduct research, prepare legal memos, and manage the judge’s docket.
- Regularly communicate with counsel as well as courthouse staff.

Family Division Law Clerks:
- Conduct legal research for the judge’s opinions and motions.
- Assist with remote proceedings and communicate with self-represented litigants and attorneys.
- Manage adjournment requests and handle emergent applications.

Civil Division Law Clerks:
- Prepare bench memoranda for civil motions and motions in limine.
- Perform legal research, interpret legal questions, and verify points of law cited by attorneys.
- Draft legal orders and manage the motion calendar.

Criminal Division Law Clerks:
- Conduct legal research for the judge’s opinions and motions.
- Assist in drafting jury instructions, legal opinions, legal orders, and sentencing memoranda.
- Manage the motion calendar and assist with remote proceedings.

General Equity (Chancery) Law Clerks:
- Conduct legal research of substantive and procedural legal matters.
- Review case files and prepare bench memoranda that summarize factual allegations and legal issues.
- Draft orders and interact with counsel and self-represented litigants regarding case management.

Education and Experience Information:
Applicants for the law clerk positions must have graduated from a law school approved by the American Bar Association by the time of their law clerk appointment. The program is intended for recent law school graduates, defined as those who have graduated within the last four years. Excellent writing and analytical skills are essential. It is also helpful for candidates to have completed a course in mediation prior to the start of the clerkship. Under Court Rule, all trial court law clerks who will serve as mediators must first complete the Judiciary-sponsored 12-hour mediation training or its equivalent.

Salary Information:
Salaries for the 2024-2025 Court Term are provided, with the following figures noted:
- Supreme Court: $76,400
- Supreme Court Appellate Division: $69,750
- Superior Court Assignment Judge: $63,950
- Superior Court Chancery Division (General Equity): $63,950
- Superior Court Law Division (Civil and Criminal): $58,900
- Superior Court Chancery Division (Family): $58,900
- Tax Court: $58,900

The salaries for the 2025-2026 Court Term are to be determined based on funding availability.

Additional Information:
- Approximately 480 clerkships are available annually.
- The Judiciary offers a hybrid work schedule, with up to four days per month of remote work possible.
- US citizenship is not required, but candidates must be authorized to work in the US.
- Law clerks may hold outside employment with prior approval as provided in the Code of Conduct for Judiciary Employees.
