The candidate represents indigent defendants and provides skilled legal counsel and courtroom advocacy at all critical phases of state-level criminal and civil commitment litigation. Conducts legal research, prepares and argues motions, writs, briefs and opinions; interviews and counsels clients; participates in developing effective investigation plans for clients; negotiates with opposing counsel; and prepares and conducts trials. Under general direction, regularly performs the most demanding and difficult criminal defense trial work; prepares and defends cases before any court within the state. Investigates, prepares for trial, and conducts trial defense of adults. Prepares trial strategy and jury instructions. Investigates, prepares for, and conducts defense of juveniles in jurisdictional and dispositional hearings. Appears with and for defendants at court hearings; decides and makes appropriate legal motions and pleas and takes other legal action on behalf of clients. Conducts legal research and prepare legal briefs and opinions. Argues the merits of probation for defendants; prepares appeals, writs and other legal correspondence. Negotiates with prosecuting authorities regarding the disposition or modification of charges. Orders investigations and subpoenas; interviews defendants and witnesses. Assists, advises, and trains lower level attorneys. Provides vacation and temporary relief as required. Supervises and directs the preparation, presentation and, if necessary, the appeal of cases in which the consequence of error could be unusually serious. Performs specialized legal research involving unique and complex areas of law. May present evidence before the Grand Jury. Directs the planning, evaluation and implementation of specialized projects. May assign and review the work of a support staff consisting of attorneys, investigators and clerical employees. May recommend appointments, promotions and discipline of department employees. Must have active membership and be in good standing in the State Bar of California with 5 years of criminal trial experience as an attorney. Should have years of criminal trial experience as an attorney OR 3 years of trial experience as an attorney. Should ideally have performed community service and volunteered time working with indigent defendants and family members. Spanish English bilingual candidates are encouraged.
