A law firm in Boston, MA, is seeking a Mid-Senior Level Patent Litigation Associate Attorney. This role involves working closely with clients to address and overcome patent-related challenges, ensuring they stay ahead of evolving patent laws and judicial decisions. The successful candidate will offer strategic solutions to navigate around competitors' patents and optimize their intellectual property assets. Patent trial experience is a plus.

Duties:

  • Collaborate with clients to identify and resolve patent-related obstacles, adapting to changes in patent laws and judicial decisions.
  • Develop and implement strategies for circumventing competitors' patents and maximizing the value of clients' intellectual property.
  • Draft and file pleadings, motions, memoranda, and correspondence for use in state and federal court proceedings, as well as in arbitration and mediation.
  • Manage complex discovery processes, including drafting and responding to discovery requests.
  • Engage in negotiations and communications with opposing counsel to advance client objectives.
  • Prepare for and conduct depositions, including witness preparation and deposition management.
  • Prepare for trial, including creating exhibit lists, formulating evidentiary objections, drafting motions in limine, and preparing witnesses.
  • Draft and file Federal Circuit appeal briefs and support appellate litigation.
  • Supervise and mentor junior associates, providing guidance on case management and professional development.

Requirements:

  • 6-8 years of patent litigation experience, with substantial experience in drafting and responding to pleadings, preparing infringement and invalidity claim charts, handling Markman and claim construction proceedings, managing patent-specific fact and expert discovery, and conducting inter partes reviews.
  • Strong academic credentials, excellent judgment, and outstanding communication skills.
  • Patent trial experience is preferred.
  • USPTO admission and an undergraduate degree in Electrical Engineering, Computer Science, or significant experience in litigating matters in these or similar technical fields are highly desired.

Education:

  • Juris Doctor (JD) from an accredited law school.
  • Undergraduate degree in Electrical Engineering, Computer Science, or a related technical field.

Certifications:

  • Admission to the USPTO is highly desirable.

Skills:

  • Expertise in patent litigation, including complex case management and legal document drafting.
  • Proficiency in managing discovery requests, conducting depositions, and trial preparation.
  • Strong negotiation, client communication, and strategic thinking abilities.
  • Ability to effectively supervise and mentor junior associates.
  • Familiarity with Federal Circuit appeal processes and appellate litigation.
